Unauthorized Religious Structures In Public Places Liable To Be Removed, Rules Gauhati HC
The bench issued this ruling on a suo motu case while directing the government of Arunachal Pradesh to take action against the unauthorized religious structures in public places.
Guwahati: The Gauhati High Court agreed with the Supreme Court's ruling that unauthorized religious structures in public places are liable to be removed, irrespective of a complaint being filed or not.
"We are of the view that what the Hon'ble Supreme Court mandates is to remove those unauthorised constructions of religious structures at public places and wherever the government so decides to regularise such construction, it is left to the wisdom of the government to do so. In other words, if there is no process for regularisation of religious structures in public places, these are liable to be removed, irrespective of whether there is a complaint from any quarter or not," a bench comprising of acting Chief Justice N Kotiswar Singh and Justice Soumitra Saikia stated in its order.
The bench issued this ruling on a suo motu case while directing the government of Arunachal Pradesh to take action against the unauthorized religious structures in public places in the state, strictly adhering to the directions of the Supreme Court.
